THREE Upper Big Branch disaster survivors who filed personal injury lawsuits against Massey Energy settled their suits out of court last year.

Mine explosion survivors settle suits

According to the West Virginia Record, Jason Stanley, Scott Halstead and Joe Ferrell represented to the Boon Circuit Court last year that the matter in dispute between each individual and the defendants had been compromised and settled, following which the cases were dismissed.

Halstead and Stanley settled their cases in October, while Ferrell settled his in June 2012.

Halstead was working at the Upper Big Branch mine as an employee of Performance Coal when the April 2010 underground explosion occurred.

According to the suit, Halstead suffered permanent physical and emotional injuries, including brain damage, and was seeking compensation, interests, expenses and punitive damages.

Stanley was a contract worker injured in the explosion and was seeking compensatory and punitive damages with interest for his “personal injuries and pain and suffering and mental anguish and distress,” according to his suit.

Ferrell worked as an hourly miner operator and was riding a mantrip with co-workers when the explosion occurred, according to the West Virginia Record.

He was seeking compensatory and punitive damages for serious permanent physical and mental injuries.
