According to the Associated Press via the Cumberland Times-News, the families of Dale Jones and Michael Wilt, led by respective widows Linda Jones and Tonya Wilt, reached an agreement late last week in Allegany County Circuit Court, Maryland.

The men were killed in an April 17, 2007 incident at the Tri-Star mine near Barton when a 275-foot highwall collapsed and buried the pair under about 93,000 tons of debris.

Jones and Wilt named Tri-Star in the civil suit as well as owner George Beener and other unnamed defendants.

The newspaper said that the settlement was in addition to the benefits the families received from workers’ compensation.

The settlement closes the case, which was initially filed in April 2010.

Tri-Star was cited by the US Mine Safety and Health Administration after the incident for failing to establish a safe ground control plan.
