The magistrate imposed the order last week as a probation condition Massey Energy must follow in order to continue operating the mine, Associated Press (AP) reported.
Since the mine was put under probation for five years in March this year, the mine has had at least three blackwater spills, which have all been reported by someone outside the company.
Other changes of the probation last week include an accelerated schedule for an initial environmental audit, and an order for environmental audits to be completed every 12 months thereafter.
In defence, an Independent Coal lawyer told AP the company needed time to implement the changes.
He told AP employees had previously been ordered to report spills to their immediate supervisors, rather than to the DEP hot line, because the individual answering the call often needs more information than is available to a rank-and-file employee.
