The Greens Party lodged a complaint with the country's Advertising Standards Complaints Board in June this year over a share offer pamphlet released by the mining company that claims the mine has a "low environmental impact".

The complaint was refused by the board which has allowed Pike River to publish its claim because it refers only to the mine, not to the end result of the burning of the coal produced.

Greens co-leader Jeanette Fitzsimons said the group will appeal the decision.

"When it is eventually burnt, the coal from this mine will release around 45 million tonnes of CO2 into the atmosphere, equivalent to more than New Zealand's entire CO2 emissions in one year. How can this not have a massive environmental impact?" Fitzsimons said.

"It is absurd to suggest that a flyer inviting investment in an enterprise can make positive environmental claims, regardless of the climate change impact of the products that it makes."
