Tinkler takes Whitehaven to court over shares

EMBATTLED coal mining magnate Nathan Tinkler has started proceedings against Whitehaven Coal in the Supreme Court of Queensland over milestone shares in the company issued to the Boardwalk Resources Trust in May 2012.

Tinkler, who claims to be trustee of the Boardwalk Resources Trust, asserts in the proceedings that he holds certain milestone shares.
 
In his statement of claim makes various allegations against Whitehaven concerning an alleged breach of contract and misleading or deceptive conduct in connection with the milestone shares. 
 
Whitehaven has vowed to defend the proceedings.
 
"However, Whitehaven understands that Boardwalk Resources Investments Pty Ltd is the owner of those shares and that Boardwalk is in liquidation," the company said in a statement.
 
"Whitehaven denies in the strongest possible terms any wrongdoing, will vigorously defend the proceedings, and seek to have it dismissed at an early stage."
