Sago survivor settles suit

LAWSUITS filed by sole Sago mine explosion survivor Randal McCloy Jr and the family of victim David Lewis against mine owner International Coal Group have been settled.

According to an Associated Press report, both settlements were reached within the last few weeks with terms that will remain undisclosed. Documentation was initially filed with the Kanawha County Circuit Court, citing the operator's negligence in maintaining safe conditions.

 

“It ensures that the McCloys and their children will be comfortable, which is the important thing," McCloy's lawyer Stephen Goodwin told the news service.

 

ICG is not speaking publicly on the matter.

 

Still pending are suits by McCloy and Lewis' family against several suppliers and contractors involved with mining operations at the time of the January 2, 2006 incident that killed 12 who were working underground during the early morning hours.

 

Lawsuits filed in the same court by the estates of the 10 remaining workers who perished at Sago are also still open.
