Lanco sues Griffin administrators

INDIAN conglomerate Lanco Infratech, which acquired Western Australian thermal coal producer Griffin Coal for $750 million in the boom times of 2011, is suing Griffin’s former administrator KordaMentha for deceptive conduct during the sales process.

“KordaMentha has denied the allegations and said they would be vigorously defended,”The West Australian reported.

“Although Lanco is said to insist the two matters are unrelated, the writ was lodged just days after the appeals bench of the New South Wales Supreme Court confirmed that paperwork errors in the sale documents for Griffin had invalidated the final $150 million payable on the $740 million deal by Lanco's bank, ICICI.”

KordaMentha has reportedly flagged a High Court appeal to that decision among other legal avenues to help force payment of the $150 million.

In regards to the Griffin sale, Lanco argued that out of date data was provided ahead of the deal which made the company overpay for coal deposits which were” 28% smaller” than what it hoped for.
