On Thursday the producer confirmed via a US Securities and Exchange Commission filing that the two submitted their petitions on September 23 in US Bankruptcy Court for the Eastern District of Missouri.

The pair is asking the court, where the troubled miner’s case is still in process, to jointly administer the bankruptcies along with Patriot and its other divisions.

In the meantime, Brody and Patriot Ventures will continue to operate their businesses as “debtors-in-possession”

St Louis-based Patriot initially filed for bankruptcy in July 2012, with assets of $US3.57 billion and debt of $3.07 billion at the end of May 2012.

The proceedings are formally known as In re: Patriot Coal Corporation, Case 12-51502.
