BMA prosecuted over Broadmeadow, proceedings ongoing

On February 27, 2006, a coal mine worker was burnt when the water truck he was driving ran down a surface access ramp, overturned and burst into flames.

A Queensland Mines Inspectorate investigation revealed faults and poor maintenance on the truck's brakes.

In February 2007 prosecution proceedings for failure to meet obligations imposed under the Coal Mining Safety and Health Act 1999 began against BMA, the site senior executive and other obligation holders.

Prosecutions against the operator and the senior site executive were heard in the Moranbah Industrial Relations Court in late December.

BMA pleaded guilty to offences and was fined $A35,000 and ordered to pay costs of more than $9300. No conviction was recorded.

No evidence was led against the site senior executive and the complaint against him was dismissed.

Proceedings against the other defendants will be heard this year.
