THE New South Wales Natural Resources Access Regulator is prosecuting Whitehaven Coal for accessing water illegally at its Maules Creek mine.

Whitehaven has previously publicly addressed aspects of NRAR’s investigation, including noting the complexity of the water management system.

NRAR said it would prosecute Whitehaven Coal in the Land and Environment Court for two alleged breaches of section 60A(2) of the Water Management Act 2000 for taking water without an access licence
