THE High Court has declined to hear an appeal by Kepco over its proposal to build a 6.5 million tonne per annum coal mine in the Bylong Valley in New South Wales.

In October Kepco sought special leave to appeal to the High Court in a final bid to overturn the refusal.

It means the South Korean company has exhausted all available legal avenues to challenge a 2019 decision by the Independent Planning Commission to refuse its Bylong Coal Project.
