According to legal journal the West Virginia Record, Crystal Bowyer has named Alpha and Elk Run Coal as defendants in her case documentation submitted on January 3 in Kanawha County Court.

Bowyer commenced her employment at the complex in September 2007 and claims she was harassed during her employment by an employee, though the operator and controlling company did not remedy the issue.

Also, the plaintiff claimed she complained of unsafe and unsanitary conditions at the operation due to an accumulation of bird droppings but no action was taken.

According to the Record, the worker claimed no safety meetings were conducted during her tenure and warnings of safety issues were not provided.

Bowyer said in her suit that she requested a transfer to another location due to the issues though that request was denied so she opted to end her employment with Elk Run on August 3, 2011.

Citing the defendant’s negligence, Bowyer is claiming Alpha and Elk Run created a hostile working environment and caused her damages, including expenses for medical care.

The case, formally known as 13-C-14, has been assigned to Kanawha circuit judge Tod Kaufman.

The journal said Bowyer, being represented by Robert Miller II and Shawn Romano, was seeking compensatory damages, reinstatement, front pay, back pay and pre and post-judgment interest.
